Mechusar Amanah

Note: this post contains no original ideas, nor even any attempts at originality. Instead, it's simply my way of making sense of a complicated issue.

While we've seen the concept of מחוסר אמנה in the פוסקים for two weeks already, yesterday was the first time we started looking into the גמרא. In brief, מחוסר אמנה is when two people reach a verbal agreement, and all the terms are agreed upon, but no money has been transfered (and obviously no קניין has been made). If one of them backs out at that point, he has done a Bad Thing™.

Kinyan after Nesinah

Last Thursday, we learned through (well, most of the way through) a קצות החושן, as per the normal Thursday night schedule. I just saw the נתיבות's response, and I admit, I'm a bit puzzled, and have a few questions (note: not that they're good questions; odds are I'm misunderstanding something). The post below summarizes the קצוה"ח as brought down in the נתיבות, which covers the main points.

Kinyan Hanaah

The טור, in 204:1, writes the following:

וכתב הרמב"ם ז"ל אבל אם היה לו חוב עליו ואמר לו מכור לי בחוב שיש לי אצלך ונתרצה המוכר הרי זה כמי שנותן דמים עתה והחוזר בו עומד במי שפרע. ובקרקע כי האי גוונא קונה לגמרי. אבל אדוני אבי הרא"ש ז"ל כתב שלא קנה אפילו המעות עדיין בעין ביד הלוה דמלוה להוצאה ניתנה ואינו נותן לו עתה כלום: אבל אם אמר לו יקנה לי שדה שלך בהנאת מחילת המלוה קנה.

Kinyan Kesef M'Derabanan

This will be the first in a (hopefully long) series of short notes about Choshen Mishpat. Our kehilla started a night program focusing on Choshen Mishpat today. I plan here to make some notes about things that strike me as interesting, confusing, or unclear.

Hopefully, one day, this will develop into a place for chiddushim and birurim. Until then, I plan to use it to store things that I want to make sure I go back to when I have enough information to actually have some answers.

Today's topic is on קניין כסף. According to the תורה, when a person wants to buy מטלטלין (any moveable object; i.e., not real estate), all he needs to do is pay for it. At the moment he pays, a קניין is effected, and the object (which he didn't touch, and may be located elsewhere) becomes his.

Batch Downloading of Lyrics for MP3

I recently wanted to try some synchronized lyric plugins for music playback. Unlike mp3/ogg files, synchronized lyrics are very hard to find. I figured my best bet would be to try and download text lyrics, and sync them myself. It's not a hard process, it just takes a few minutes.

Actually downloading the lyrics, though, can be slow. Many sites provide user contributed lyrics, but they're not set up nicely for easy downloading. Before I started to write my own perl parser, I decided to search CPAN, and came up with David Precious' outstanding Lyrics::Fetcher package. If you download his Bundle::Lyrics::Fetcher, you get the main fetcher, as well as modules LyricWiki, AZLyrics, and AstraWeb.

One I had this installed, the script to do this for all my music was quite simple. The only configuration needed is in the first variable; add a list of everywhere you have music. Note that this script currently only works for MP3; it could easily be expanded to process tags with other formats, however.
