		<description>The גמרא in בבא מציעא on 48b seems to suggest that somethings remains on a דאורייתא level, even though we do not say a קניין took place. According to the opinion that מי שפרע is a curse, how can בית דין curse another Jew for violating "just" a דרבנן; what about דאורייתא issue of "עמך" (TODO- full citation)? If, however, the person did something wrong on a דאורייתא level as well, perhaps it may be permissible to curse him.</description>
